By purchasing any product or service from Krystal Hudson (ABN 44 270 696 671) ("Contractor", "I", "me", "my"), the purchaser ("Client", "you") agrees to the following Terms & Conditions. These terms apply to all purchases made through krystalhudson.com via Kajabi.

Please note: These Terms & Conditions apply to services purchased directly through this website. Project-based and retainer clients receive separate terms via their proposal and invoice documentation.

Term

These Terms & Conditions begin immediately upon purchase by the Client and remain in effect for the duration of the service or product access period.

Service Delivery & Availability

General
All services are delivered virtually. This business operates Monday to Friday, 9am to 5pm ACST (Adelaide, South Australia). Weekends and South Australian public holidays are closed.

Pick My Brain — 15-Minute WhatsApp Session
Following purchase, the Client will receive a WhatsApp link and QR code via email. The Client must initiate their session within 7 days of purchase, after which the session expires. Krystal will respond within 2 hours during business hours (Monday to Friday, 9am–4pm ACST). The 15-minute support window begins when Krystal sends her first reply. The Client must be available to exchange messages in real time during this window. This is an advice-only session — no implementation work is included.

WhatsApp Support — 4-Week Package
The 4-week support period begins when the Client sends their first WhatsApp message. Replies are provided same-day during business hours (Monday to Friday, ACST). Messages received outside business hours will be responded to on the next business day. This is a guidance-only service — the Client completes the work themselves based on Krystal's advice. No implementation or done-for-you work is included.

Power Hour
Power Hour sessions are booked and paid for simultaneously via Krystal's online booking link. Availabilty is Monday to Friday, ACST. By purchasing and booking a Power Hour, the Client is securing a dedicated block of Krystal's time. All Power Hour purchases are final and non-refundable. Sessions must be used within 90 days of purchase. If the Client needs to reschedule, a minimum of 24 hours notice is required via email to [email protected]. Failure to provide adequate notice or failure to attend will result in the session being forfeited.

VIP Day & VIP Half Day
VIP Day and VIP Half Day bookings are confirmed following a scoping discussion with Krystal to establish the project scope. Once scope is agreed:

A non-refundable deposit of $200 AUD is required to secure the date in Krystal's calendar.
The remaining balance is due 1 week prior to the VIP Day date.
A minimum of 48 hours notice is required to reschedule. Rescheduling requests with less than 48 hours notice cannot be accommodated.
A rescheduling fee of $200 AUD applies to all reschedules, payable before the rescheduled date is confirmed. This reflects the inability to fill the vacancy at short notice.
All rescheduled sessions must be rebooked within 90 days of the original date.
VIP Day and VIP Half Day purchases are non-refundable once the deposit has been paid.

Digital Products & Templates

License
By purchasing a digital product or template from Krystal Hudson, the Client is granted one revocable, worldwide, non-exclusive, non-transferrable license to the purchased product. The Client will receive access to their digital product within 48 hours of purchase via a download link delivered by email. The Client is responsible for downloading and saving the product to their own device, which entitles them to lifetime access to that product.

Attribution
By purchasing a template from Krystal Hudson, the Client agrees to display "Designed by Krystal Hudson" in the footer of that template.

Restrictions
The Client may not republish, reproduce, duplicate, copy, sell, display, disclose, or distribute any purchased product or its content to any third party, or use it in any way that earns the Client or any third party money beyond its general application in the Client's own business. Downloading or using the product does not transfer ownership — all intellectual property remains the property of Krystal Hudson. Any unauthorised use constitutes infringement.

Done-For-You Add-On Services
Where a done-for-you add-on service is purchased alongside a digital product, Krystal will make contact with the Client and request the following deliverables within 7 business days:

Branding colours
Copy (written content)
1 x headshot photo
A list of relevant links and URLs

The completed work will be delivered within 7 business days of receiving all of the above from the Client. Done-for-you services are a "fit out" service only and do not include adjustments to original template designs beyond personalisation and branding.

Refund Policy

Due to the time-based and digital nature of these services and products, the following refund policy applies:

Pick My Brain & WhatsApp Support: All purchases are final and non-refundable.
Power Hour: All purchases are final and non-refundable. Sessions must be used within 90 days of purchase.
VIP Day & VIP Half Day: The $200 deposit is non-refundable. The remaining balance is non-refundable once paid. Rescheduling is available with adequate notice subject to the conditions outlined above.
Digital Products & Templates: Due to the immediately accessible nature of digital products, no refunds are available under any circumstances once the product has been delivered.

Capacity — Independent Contractor

In providing any services to the Client, it is expressly agreed that Krystal Hudson is acting as an independent contractor and not as an employee. Krystal retains full control over working time, methods, and decision-making in relation to the provision of services, while remaining responsive to the reasonable needs and concerns of the Client.

Intellectual Property — Client Work

All intellectual property and related material developed or produced for the Client under any service agreement — including trade secrets, moral rights, goodwill, and rights in any patent, copyright, trade mark, trade dress, industrial design, and trade name — will be the sole property of the Client upon full payment. The Contractor may not use the Client's intellectual property for any purpose other than that contracted for, except with the written consent of the Client.

Confidentiality

Krystal Hudson agrees not to disclose, divulge, reveal, report, or use any confidential information relating to the Client obtained during the provision of services, except as authorised by the Client or as required by law. Confidential information includes any business or personal data that would reasonably be considered private or proprietary to the Client. This obligation of confidentiality applies during and indefinitely after the term of any service agreement.

Legal & Financial Disclaimer

The services provided by Krystal Hudson are not a substitute for advice from a licensed attorney, accountant, psychologist, or financial advisor. Nothing communicated during any service constitutes business, financial, or legal advice. Clients are encouraged to consult with appropriately qualified professionals regarding their specific personal, business, or financial situation.

Earnings Disclaimer

All services are intended to provide information, education, and implementation support to assist the Client in achieving their goals. The Client's success depends entirely on their own business experience, motivation, and individual capacity. There are no guarantees of any kind regarding earnings or income outcomes.

Mutual Indemnification

Except to the extent paid in settlement from any applicable insurance policies, and to the extent permitted by applicable law, each Party agrees to indemnify and hold harmless the other Party, and its respective affiliates, officers, agents, employees, and permitted successors and assigns, against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, and reasonable legal fees of any kind, which result from or arise out of any act or omission of the indemnifying party in connection with these Terms & Conditions.

Dispute Resolution

Any controversy or claim arising out of or relating to these Terms & Conditions or the services provided shall first be submitted to mediation, conducted by a mutually agreeable party, for a minimum of six hours. If mediation does not resolve the dispute, it shall be settled by binding arbitration in South Australia, Australia, in accordance with applicable arbitration rules. The arbitrator shall have no power to alter, amend, or modify any terms of this agreement, nor to grant any remedy not available in a court of law.

Governing Law

These Terms & Conditions are governed by the laws of South Australia, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of South Australia.

Changes to These Terms

Krystal Hudson reserves the right to update these Terms & Conditions at any time. Updated terms will be posted on this page with a revised date. Continued use of services following any update constitutes acceptance of the revised terms.
